James Browne, the Minister for Housing, Local Government and Heritage recently provided an update to Cabinet on the Implementation Plan for the Planning and Development Act 2024 ("the Act").

The Act will be commenced on a phased basis separated into four blocks (A, B, C and D).

It is anticipated that Block A will commence in early Quarter 2 of 2025 and will include the establishment of An Coimisiún Pleanála to replace An Bord Pleanála and provisions relating to Judicial Reviews.

Block B is anticipated to commence in mid-2025 pending further engagement with local authorities, regional assemblies and the Office of the Planning Regulator. Block B includes the commencement of Part 3 of the Act - Plans, Policies and Related Matters and Chapters 1 and 2 of Part 6 (Environmental Assessment).

Following commencement of Blocks A and B, it is proposed to commence Blocks C and D which includes provisions on Development Consents, Enforcement and all remaining sections of the Act. The Implementation Plan provides that further details of timing of Block C and D commencements will be provided once work progresses on commencing Blocks A and B.

The existing provisions in the current Planning and Development Act 2000 (as amended) will remain in place until the relevant provisions of the Act are commenced.

An Oversight Group for implementation of the Act has been established and includes representatives from the local authorities, regional assemblies, An Bord Pleanála, the Office of the Planning Regulator and state infrastructure/utility providers. The Oversight Group will monitor and review progress on the delivery of the Implementation Plan on a quarterly basis.
